A Hudson Valley dentist was acquitted of murdering his lover’s husband in 2011.

Tuesday, an Ulster County Jury found 49-year-old Gilberto Nunez not guilty of 2nd-degree murder.

According to the Daily Star, the Kingston dentist was accused of killing 44-year-old Thomas Kolman, of Saugerties by giving him coffee laced with a dental sedative.

Kolman’s body was found inside his car at a gym parking lot in Ulster County in November 2011.

The Ulster County District Attorney’s Office previously said Nunez’s SUV was seen on video surveillance traveling to and from the scene. Officials alleged Nunez was having an affair with Kolman’s wife, Linda.

In October of 2015 the D.A.’s office said Kolman was killed by a sedative called Midazolam, a drug that is only available to dentists and can’t be purchased by the public.

Investigators say they found a search history for the drug on Nunez’s computer.

Nunez’s defense team argued that Nunez had nothing to do with the death. Citing Kolman’s heart condition and sleep apnea as possible factors.

While being found not guilty of murder, Nunez was found guilty of forgery for claiming he was a member of the CIA.
